Ski Bum Contest

TO COMPLETE YOUR ENTRY YOU MUST READ AND AGREE TO THE FOLLOWING TERMS. PARTICIPATION IN THIS CONTEST CONSTITUTES FULL AND UNCONDITIONAL AGREEMENT AND ACCEPTANCE OF THESE CONTEST RULES.

1. Eligibility
   The Ultimate Ski Bum Contest is open to participants that are/have: 19 years of age as of December 1, 2009 Valid drivers license and can legally operate a vehicle in Canada All entries will be approved by Kootenay Rockies Tourism before being uploaded to the PowderHighway YouTube channel - the official place for all entries to be showcased. All entries must not infringe upon any rights, are appropriate in nature and abide by the Contest rules.
2. Contest Timeline Contest opens for entries: October 5, 2009 Deadline for entries: November 22, 2009 Judging: November 23 to December 1, 2009 Winner announced: December 1, 2009
3. Entry Requirements
   (a) Length During the Contest period, create and submit a video up to 90 seconds in length. (b) Subject Matter The Video must express why the depicted participant would be worthy of being the Powder Highway Ultimate Ski Bum. An Entry should be creative, interesting, meaningful and/or fun. You may use any visual medium to produce the Video including, but not limited to, film and digital slideshows. (c) Format Each Entry must be uploaded to YouTube and the link code sent in the entry form to allow the video to be shown in the PowderHighway YouTube Channel. Each participant can enter up to a total of one (1) Entry during the Entry Period. (d) Waivers Where applicable, participants must obtain approval from all individuals featured in their Entries and complete the Entry Form and applicable permission(s). If a participant chooses to use music with their Entry, they must only use tracks for which they are the copyright owner or licensed owner, or which are from an open source. (e) Content Restrictions The Entries must not contain: (f) Nudity, profanity, or vulgar behaviour; (g) Exclusion & Disqualification Entries that do not comply with these Official Rules may be disqualified. Any Entries that are deemed to be inappropriate, obscene or otherwise do not comply with the Content Restrictions, as determined by Kootenay Rockies Tourism in its sole discretion, may be disqualified. Furthermore, and without limitation to the foregoing, Kootenay Rockies Tourism reserves the right in its sole discretion to reject Entries that contain materials that are copyrighted, trademarked, or otherwise subject to third party proprietary rights unless the participant is the owner of such rights or has permission from the rightful owner to include such material in the Entries.
4. Property in the Entries
   Upon submission, all Entries become the exclusive property of Kootenay Rockies Tourism, and may be used in any and all future promotions. Kootenay Rockies Tourism shall have the unrestricted right to use, edit, publish, broadcast, or stream in any or all of the Entries as well as the name, picture, statements, biographical information and likeness of any and all participants without further approval or compensation. By entering this Contest, each participant unconditionally assigns and absolutely transfers to Kootenay Rockies Tourism in perpetuity any and all rights, titles and interests in each Entry including, without limitation, all copyrights and the exclusive right publicly to use, duplicate and exhibit, and to authorize others to use, duplicate and exhibit, its Entries.
5. Cancellation, Modification or Suspension of Contest
   If, for any reason, the Contest is not capable of running as planned by causes which, in the sole opinion of Kootenay Rockies Tourism, may affect the administration, fairness, integrity or proper conduct of this Contest, Kootenay Rockies Tourism reserves the right, in its sole discretion, to modify, cancel or suspend the Contest.
6. Selection of Winner
   The Ultimate Ski Bum Contest winner will be determined by a panel of judges comprised of Powder Highway Resort representatives. All Entries will be judged for creativity, style, personality, skiing/snowboarding ability, charisma and/or video and tech savvy. We're looking for creative and original videos that showcase why you'd be chosen to be the Ultimate Ski Bum – and we want you to have fun with them! The panel's decisions regarding any and all aspects of the Contest are final.
7. Acknowledgement, Warrant & Indemnity
   By entering the Contest, participants are hereby deemed to: (a) acknowledge that they are solely responsible for their own Entries and the consequences of publishing them on YouTube, (b) warrant that their Entries are their own original work and do not infringe any other person's rights, and (c) indemnify, defend and hold harmless Kootenay Rockies Tourism and each of their directors, officers, employees, partners, sponsors, prize suppliers and their agents for all liability resulting from or related to any claims, actions, damages, losses or costs arising by reason of this Contest and their participation therein including, without limitation,: (i) infringements of intellectual property rights, (ii) public dissemination of the Entries, both through YouTube and through any use of the Entries by Kootenay Rockies Tourism, and (iii) invasion of privacy, libel or slander related to the Entries.
8. Contest Prizes
   The winner of the Ultimate Ski Bum Contest will receive the following during the period of January 1, 2010 and March 31, 2010: One (1) lift pass per day at one (1) of the following Powder Highway Resorts: Red Mountain Resort, Whitewater Ski Resort, Revelstoke Mountain Resort, Kicking Horse Mountain Resort, Panorama Mountain Village, Fairmont Hot Springs Resort, Kimberley Alpine Resort, Fernie Alpine Resort One (1) Day of Heli/Cat-Skiing (subject to availability) at: Island Lake Catskiing, Powder Cowboy, Great Canadian Heli-Skiing, Purcell Heli-Skiing, Retallack Resort, White Grizzly, Selkirk Wilderness Skiing, Highland Powder Skiing, Monashee Powder Snowcats, CMH Kootenay Heli-Skiing, Snowwater Heli-Skiing, Valhalla Powdercats, RK Heli-Ski, Selkirk Tangiers Heli-Skiing, Revelstoke Mountain Resort, Big Red Cats. A maximum of ten (10) nights of accommodation for one (1) person at each of the following: Prestige Inn Rocky Mountain Resort, Fairmont Hot Springs Resort, Park Vacation Management, Raging Elk Adventure Lodge, Best Western Fernie Mountain Lodge, Snow Valley Motel, Fernie Lodging Company, Prestige Mountainside Resort, Highland Lodge, Trickle Creek Lodge, Monashee Powder Snowcats, CMH Kootenay Heli-Skiing, Prestige Inn Lakeside or Lakeview, Hume Hotel, New Grand Hotel, Panorama Mountain Village, High Country Properties, Prestige Radium Hot Springs, Bighorn Meadows Resort, Sandman Inn Revelstoke, Glacier House Resort, Prestige Mountain Resort, The Flying Steamshovel and Rossland Motel. The use of a supplied vehicle. A $500 gas card from Husky. The Contest Prize must be accepted as offered and no substitutions are allowed. Contest Prizes consist of only those items specifically listed as part of the prize – any feature, cost or expense not specifically listed as part of the prize is the sole responsibility of the winner. In the event that the recipient of the prize either withdraws from the Contest or is unable to claim the prize within the prize period, Kootenay Rockies Tourism may award the prize to the next selected candidate. The winner of the Ultimate Ski Bum agrees to fulfill obligations including and not limited to video blogging experiences with each prize supplier, events and conducting themselves as an ambassador of the Powder Highway, respecting the property and rules of each of the prize suppliers and the laws of British Columbia, Canada. Kootenay Rockies Tourism reserves the right to terminate the Ultimate Ski Bum Contest prize at any time. Participants declare their understanding of these rights when they enter the Contest.
9. Use of the Videos
   Any of the Entries may be used for promotional, and/or informational materials produced by Kootenay Rockies Tourism. Kootenay Rockies Tourism reserves the right not to use any Entries submitted in the Contest. Kootenay Rockies Tourism also reserves the right to edit Entries for purposes deemed necessary by the Program. Participants declare their understanding of these rights when they enter the Contest.
10. Disclaimer and Release
    Kootenay Rockies Tourism is not responsible or liable for any lost, late, incomplete, invalid, corrupted, incorrectly addressed Entries or any damage or loss arising from, or connected with the Contest. Kootenay Rockies Tourism assume no responsibility for electronic hardware, software malfunctions or technical failures of any kind, or the incorrect or inaccurate capture of any Entry or other information, whether caused by participants, or by any equipment associated with or utilized in the Contest. By participating in this Contest, each participant hereby agrees to release and discharge Kootenay Rockies Tourism and each of their directors, officers, partners, employees, sponsors, prize suppliers and agents from all actions, claims and demands whatsoever arising directly or indirectly out of their participation in this Contest.
11. Disputes
    Participants agree that any and all disputes and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved under the laws of British Columbia, without respect to any conflict of law issues, and participants agree that such shall be resolved individually, without resort to any form of class action. This Contest shall in all respects be construed and enforced in accordance only with the laws of British Columbia and all participants hereby irrevocably consent to and submit themselves to the jurisdiction of the courts of British Columbia.
